These Terms of Service (“Terms”) govern the services I provide as a freelance web designer. By contacting me, requesting services, or using my website, you agree to these Terms.

1. About Me

I am Lydia Phillips, a sole trader based in Stoke-on-Trent, England, UK, trading as Lydia Phillips Design. You can contact me at:

2. Services

I provide web design services, which may include:

  • Website design and development for businesses and individuals
  • Website maintenance and updates
  • Graphic design and branding for websites
  • White-label website design and development for other web designers and agencies

The specific services and deliverables will be agreed in writing before work begins.

3. Quotes, Payments, and Invoices

  • I provide a written quote or proposal before starting any project.
  • A deposit of 50% may be required before work begins.
  • The remaining balance is due upon project completion or according to the agreed schedule.
  • Payments can be made via bank transfer.
  • Late payments may incur interest or delay in project delivery.

4. Project Timeline

  • I will provide an estimated timeline in the project proposal.

  • Timelines may change due to client delays, changes in scope, or unforeseen circumstances.

  • I will communicate any changes to the timeline as soon as possible.

5. Intellectual Property

  • I retain copyright of all work I create until full payment is received.

  • Upon full payment, you are granted a licence to use the delivered work for the agreed purpose.

  • I may showcase the work in my portfolio unless you request otherwise in writing.

6. Client Responsibilities

You agree to:

  • Provide all necessary materials, content, and access in a timely manner.
  • Respond to emails or messages promptly to avoid project delays.
  • Review work and provide feedback within agreed deadlines.

7. Revisions and Changes

  • Revisions may be included and will be specified in the proposal.
  • Additional work outside the agreed scope may incur extra fees.

8. Limitation of Liability

  • I provide services with reasonable care and skill, but I do not guarantee that websites will be error-free or meet all expectations.
  • I am not liable for any indirect, incidental, special, or consequential losses, including lost profits, business interruptions, or data loss.
  • I am not responsible for losses or damages caused by third-party services, hosting issues, or external factors outside my control.

9. Termination

  • Either party may terminate the agreement in writing.

  • If the client terminates the project early, they agree to pay for:
    - Work completed up to the termination date, and
    - Any non-recoverable costs incurred, including third-party fees or software purchases.
  • Deposits paid before the project starts are non-refundable.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts of England and Wales.
